Data Access Terms
Read and agree below — this is the last step before we send you a payment link for evaluation access.
These terms are between you ("Customer") and The Lead You Need, Inc. ("Company"), operator of theleadyouneed.com.
1. What you're getting
90 days of API access to the FL Property Risk Pack endpoint, starting from the date your key is issued, subject to the rate limits stated in the documentation (currently 60 requests/minute, 1,000/day). Access ends automatically at the end of the term unless renewed.
2. What the data is — and isn't
All data returned by the Service is aggregated at the ZIP or county level across a minimum of 25 underlying properties or events per data point. It is:
- NOT a determination about any individual property or address.
- NOT a Special Flood Hazard Area (SFHA) designation or any official flood-zone determination.
- NOT insurance, underwriting, engineering, legal, or investment advice.
- NOT guaranteed to be current, complete, or error-free.
- Sourced in part from public government data (FEMA National Risk Index, NOAA Storm Events Database, U.S. Census Bureau), aggregated and combined by Company.
Customer is solely responsible for how it uses this data, including any business, underwriting, pricing, or lending decisions made using it. Company is not responsible for outcomes resulting from Customer's use of the Service.
3. Ownership
Company owns the Service, the underlying methodology, and all data outputs. Customer receives only a limited, non-exclusive, non-transferable license to use the data for the permitted purposes below, for the duration of the access term.
4. Permitted use
Customer may use the data internally for its own business purposes (e.g., underwriting analysis, inventory planning, portfolio risk review) for the duration of the access term.
5. Key custody
Customer is responsible for safeguarding its API key. All activity under the key is attributed to Customer, whether or not Customer performed it directly.
6. Not permitted
Customer may not:
- resell, sublicense, redistribute, or otherwise make the raw data feed available to any third party;
- represent this aggregate data as a property-specific or address-specific determination to any third party, including end customers or regulators;
- attempt to re-identify, de-anonymize, or reverse-engineer any individual property or event from the aggregated data, or combine it with other data sources for that purpose;
- use the Service to build a competing aggregate data product.
7. Payment
The access fee is for the stated term and is non-refundable once your API key has been issued. Renewal, if offered, will be at Company's then-current pricing.
8. No warranty
The Service and all data are provided "as is" and "as available," without warranties of any kind, express or implied, including any warranty of uptime, availability, or fitness for a particular purpose.
9. Indemnification
Customer agrees to defend and indemnify Company against any third-party claims, damages, or costs arising from Customer's use or misuse of the data — including any claim that Customer misrepresented aggregate data as a property-specific determination.
10. Limitation of liability
Company's total liability arising from this agreement is limited to the amount Customer paid for the Service. Company is not liable for indirect, incidental, or consequential damages arising from Customer's use of the data.
11. Confidentiality
Customer will keep the pricing and terms of this agreement confidential unless Company agrees otherwise in writing.
12. Term and termination
This agreement lasts for the access term stated above. Company may revoke access immediately for violation of these terms. Either party may decline to renew at the end of the term.
13. Assignment
Customer may not transfer or assign this agreement to another party without Company's prior written consent.
14. Governing law
This agreement is governed by the laws of the State of Florida. Any dispute will be resolved in the courts of Florida.
15. Entire agreement
This document, together with the payment receipt, is the entire agreement between the parties and supersedes any prior verbal or written discussions.
